Farewell Fund (Pty) Ltd (registration number 2026/485454/07) ("Farewell Fund", "we", "our" or "us") operates an online crowdfunding platform dedicated to helping individuals, families and communities raise funds for funeral and memorial-related expenses throughout South Africa.

By accessing or using our website, mobile services or any of our fundraising services (collectively referred to as the "Services"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you should not access or use our Services.

Please also read our Privacy Policy, our Cookies and Tracking section, Donation Refund Policy and any other policies published on our website, as they form part of these Terms and Conditions.

From time to time we may amend these Terms and Conditions to reflect changes in legislation, our services or our business operations. Where reasonably possible, we will notify registered users of any material changes by email or by posting a notice on our website. Your continued use of Farewell Fund after such changes have been published constitutes acceptance of the revised Terms and Conditions.

Farewell Fund is intended for personal and lawful fundraising activities only. Our platform is designed exclusively for online fundraising campaigns that collect monetary donations for funeral-related expenses. Requests for donations in kind, prize competitions, raffles, lotteries, investment opportunities or rewards in exchange for donations are not permitted.

2. Registration and Campaign Creation

Anyone may browse Farewell Fund without creating an account. To create a fundraising campaign, manage an existing campaign or receive funds through Farewell Fund, you must first register an account and provide complete, accurate and up-to-date information.

By registering an account, you agree that:

  • All information provided is accurate and truthful.
  • You will promptly update any information that changes.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You will immediately notify Farewell Fund if you believe your account has been accessed without your permission.

Farewell Fund reserves the right to suspend or terminate any account or campaign where false, misleading or incomplete information has been provided.

3. Who May Create a Campaign

Funeral fundraising campaigns may be created by:

  • An immediate family member of the deceased;
  • A relative of the deceased;
  • A close friend;
  • A colleague;
  • A community representative;
  • A funeral parlour acting with the family's authority; or
  • Any other person authorised by the deceased's next of kin or lawful representative.

Campaign organisers must have permission to raise funds on behalf of the beneficiary or the deceased's family where applicable.

Individuals under the age of 18 may assist in creating or promoting a campaign; however, all funds will only be paid into a verified bank account held by a person who is 18 years of age or older and who has successfully completed Farewell Fund's verification process.

4. Our Role

Farewell Fund provides an online platform that enables campaign organisers to connect with donors who wish to assist with funeral-related expenses. Farewell Fund does not create fundraising campaigns on behalf of users and does not guarantee that any campaign will receive donations or achieve its fundraising goal.

The success of every campaign depends on many factors beyond our control, including public support, campaign promotion and donor participation.

Farewell Fund does not endorse any campaign, beneficiary, campaign organiser or donor, nor do we guarantee the accuracy of every statement made by campaign organisers.

Before making a donation, donors are encouraged to satisfy themselves that they wish to support the campaign and understand the purpose for which funds are being raised.

5. Verification of Campaigns

To protect donors, beneficiaries and the integrity of the platform, Farewell Fund reserves the right to verify every fundraising campaign before releasing funds. Verification may include requesting one or more of the following:

  • South African Identity Document or Passport;
  • Death Certificate;
  • Funeral quotation or invoice;
  • Proof of relationship to the deceased;
  • Banking confirmation letter;
  • Proof of address;
  • Funeral parlour confirmation;
  • Letters from hospitals, traditional authorities or religious institutions where applicable; and
  • Any additional documentation reasonably required to verify the legitimacy of the campaign.

Campaign organisers agree to cooperate fully with Farewell Fund's verification process. Failure to provide the requested information may delay the activation of a campaign, delay payment of funds or result in the suspension or removal of the campaign.

Farewell Fund reserves the right to decline, suspend or permanently remove any campaign that cannot be satisfactorily verified or that is believed to contain false, misleading or fraudulent information.

6. Prohibited Activities

Farewell Fund is committed to maintaining a safe, respectful and trustworthy platform for everyone. By using our Services, you agree that you will not upload, publish, share or distribute any content that:

  • Is false, misleading or intentionally inaccurate.
  • Is fraudulent or intended to deceive donors.
  • Contains defamatory, abusive, threatening, discriminatory, hateful, obscene or offensive material.
  • Promotes violence, harassment or intimidation.
  • Violates the privacy or legal rights of another person.
  • Infringes any copyright, trademark or other intellectual property rights.
  • Contains viruses, malware or any software intended to damage or interfere with the operation of the website.
  • Promotes illegal activities or violates any applicable South African law.
  • Advertises investment schemes, gambling, lotteries, raffles, pyramid schemes, cryptocurrencies, debt collection services or financial products unrelated to funeral fundraising.
  • Requests donations for purposes other than genuine funeral or memorial-related expenses.
  • Offers prizes, rewards or incentives in exchange for donations.
  • Publishes banking details on campaign pages without Farewell Fund's approval.
  • Includes photographs or videos that you do not have permission to use.

Farewell Fund reserves the right to remove any content or suspend any account that breaches these Terms and Conditions.

7. Acceptable Use of the Platform

When using Farewell Fund you agree that you will not:

  • Attempt to gain unauthorised access to our systems or another user's account.
  • Interfere with the operation or security of the website.
  • Collect, copy or distribute another user's personal information without their consent.
  • Use automated software, bots or scripts to access the platform without written permission.
  • Misrepresent your identity or your relationship to the beneficiary.
  • Circumvent Farewell Fund's verification procedures.
  • Use the platform for money laundering, fraud or any unlawful activity.

Any breach of these obligations may result in the immediate suspension or permanent termination of your account.

8. Relationship Between Campaign Organisers and Donors

Farewell Fund provides the technology that enables campaign organisers to raise funds from donors. When a donor makes a contribution to a campaign, a direct relationship is created between the donor and the campaign organiser or beneficiary.

Farewell Fund is not a party to that relationship and does not become the owner or custodian of the donated funds beyond what is reasonably necessary to process payments, complete verification procedures and facilitate payouts.

Campaign organisers agree to:

  • Use donations solely for the funeral-related purpose described in the campaign.
  • Act honestly, transparently and in good faith.
  • Provide accurate updates where appropriate.
  • Cooperate fully with Farewell Fund if additional verification is required.

Donors acknowledge that:

  • Donations are voluntary.
  • Farewell Fund cannot guarantee that every campaign will achieve its fundraising goal.
  • Funeral arrangements may change due to circumstances beyond the organiser's control.

9. Funeral Fundraising Campaigns

Farewell Fund specialises exclusively in funeral crowdfunding. Campaign organisers must ensure that every fundraising campaign clearly explains:

  • The circumstances surrounding the fundraising request.
  • The intended use of the funds.
  • The relationship between the organiser and the deceased or beneficiary.
  • The estimated funeral expenses where available.

Campaign organisers should provide sufficient supporting information to enable donors to make informed decisions before contributing.

10. Campaign Verification and Administration

Farewell Fund takes the integrity of fundraising seriously. Every campaign may be reviewed before funds are released. Verification may include contacting:

  • Family members.
  • Funeral parlours.
  • Medical facilities.
  • Religious organisations.
  • Employers.
  • Community leaders.
  • Other relevant persons or organisations.

Farewell Fund reserves the right to request additional supporting documentation at any stage of the campaign.

Campaigns may be declined, suspended or removed where:

  • Information cannot be verified.
  • Supporting documentation is insufficient.
  • The fundraising target appears unreasonable or misleading.
  • Fraud is suspected.
  • The campaign breaches these Terms and Conditions.
  • The campaign is inconsistent with Farewell Fund's purpose.

The decision whether to approve, suspend or remove a campaign rests solely with Farewell Fund.

11. Farewell Fund Assisted Campaigns

To increase donor confidence and ensure that donations are used for their intended purpose, Farewell Fund may, at its discretion, administer all or part of a fundraising campaign.

An administered campaign means that Farewell Fund may pay approved funeral-related expenses directly to:

  • Funeral parlours;
  • Municipalities;
  • Cemeteries;
  • Crematoriums;
  • Transport providers;
  • Monument or tombstone suppliers; or
  • Other verified service providers.

Direct payment to suppliers may be made instead of paying funds directly to the campaign organiser or beneficiary. Where Farewell Fund considers it appropriate, supporting invoices or quotations may be required before payment is made.

Farewell Fund reserves the right to convert any campaign into an administered campaign where this is necessary to protect donors, beneficiaries or the integrity of the platform.

If a campaign organiser requests that funds be paid directly to them instead of an approved service provider after donations have been received, Farewell Fund may require additional verification and may, where appropriate, notify donors before approving the change.

12. What Farewell Fund Does and Does Not Do

Farewell Fund provides a secure online platform that enables campaign organisers to raise funds for funeral and memorial-related expenses. While we strive to maintain a safe and trustworthy fundraising environment, Farewell Fund acts solely as a facilitator of donations and is not responsible for managing funeral arrangements or supervising how funds are ultimately used once they have been paid to the verified beneficiary or an approved service provider.

Farewell Fund will:

  • Provide a secure online fundraising platform.
  • Process donations through approved payment service providers.
  • Verify campaigns before releasing funds where required.
  • Assist campaign organisers throughout the fundraising process.
  • Investigate reports of suspected fraud or misuse of the platform.

Farewell Fund does not:

  • Guarantee that any campaign will receive donations.
  • Guarantee that a fundraising target will be achieved.
  • Guarantee that donations will be tax deductible.
  • Guarantee the accuracy of every statement made by campaign organisers.
  • Become a party to any agreement between donors and campaign organisers.
  • Accept responsibility for funeral services provided by third-party suppliers.

Campaign organisers should not commit to funeral expenses in reliance on anticipated donations until funds have been successfully verified and released.

13. Administration Fee and Payment Processing Fees

Creating a fundraising campaign on Farewell Fund is free. No fees are charged unless donations are successfully received.

Farewell Fund charges an Administration Fee of 8%, inclusive of Value-Added Tax (VAT), on donations processed through the platform. This amount is added to what the donor pays at checkout and shown as its own line item before payment is confirmed — it is not deducted from the donation or from the organiser's payout, so the campaign is credited with the full donation. The Administration Fee contributes towards the cost of:

  • Campaign verification;
  • Fraud prevention;
  • Secure payment processing;
  • Banking charges;
  • Customer support;
  • Website hosting and maintenance;
  • Technology development;
  • Compliance with applicable laws and regulations; and
  • The ongoing operation and improvement of Farewell Fund.

In addition to the Administration Fee, a payment processing fee charged by our third-party payment service provider applies to each donation. This fee is added to the amount the donor pays and is shown as a separate line item during the donation process, before payment is confirmed. The fee is calculated so that, after the provider deducts its charge, the full donation and the Administration Fee still reach their intended recipients. The exact rate depends on the payment method the donor selects and may be updated in line with the provider's published pricing.

Farewell Fund reserves the right to amend its Administration Fee or the payment processing fees it passes on from time to time. Any changes will be published on the website before taking effect.

14. Payment of Funds

Before any funds are released, Farewell Fund may require the successful completion of its verification process. Funds may be paid to:

  • The verified beneficiary;
  • The verified campaign organiser;
  • An authorised funeral parlour;
  • A verified cemetery or crematorium;
  • Another approved supplier providing funeral-related goods or services.

Farewell Fund reserves the right to determine the most appropriate payment method in order to protect donors and ensure that funds are used for their intended purpose.

Payments will only be made to verified bank accounts approved by Farewell Fund.

15. Standard Payout Schedule

Subject to successful verification, Farewell Fund aims to process campaign payouts on a monthly basis. Donations received during a calendar month will normally be included in the following scheduled payout cycle.

To protect campaign organisers and donors against payment reversals, fraudulent transactions and banking disputes, donations may be held for a reasonable clearance period before becoming eligible for payout.

Farewell Fund reserves the right to delay payment where additional verification is required or where unusual activity has been detected.

16. Urgent Payout Requests

Farewell Fund understands that funeral expenses often require immediate financial assistance. Where a campaign organiser demonstrates an urgent need for funds before the normal payout date, Farewell Fund may, at its sole discretion, consider an expedited payout request.

Urgent payout requests must:

  • Be submitted in writing;
  • Explain the reason for the request;
  • Include any supporting documentation requested by Farewell Fund; and
  • Satisfy all verification requirements.

Approval of an urgent payout remains entirely at Farewell Fund's discretion.

17. Donations

All donations made through Farewell Fund are voluntary gifts intended to assist with funeral-related expenses. By making a donation, the donor acknowledges and agrees that:

  • Donations are made voluntarily.
  • Donations are generally irrevocable once successfully processed.
  • Donations do not create any ownership rights or financial interest in the campaign.
  • Donations do not guarantee any particular outcome or result.

Farewell Fund reserves the right to refuse, suspend or reverse donations where fraud, payment errors, legal requirements or security concerns make such action necessary.

18. Donation Refunds

Donation refunds are governed by Farewell Fund's separate Donation Refund Policy. Refund requests will only be considered under the circumstances described in that policy.

Where a refund is approved, Farewell Fund may deduct any non-refundable banking charges, payment processing fees or other costs incurred in processing the original donation, to the extent permitted by law.

Where funds have already been paid to the beneficiary or an approved service provider, Farewell Fund may not be able to recover or refund the donated amount.

Each refund request will be assessed individually based on the circumstances of the donation and the requirements of the Donation Refund Policy.

19. Intellectual Property

The content you upload to your campaign, including photographs, videos, written stories and supporting documents, remains your property or the property of the person who has authorised you to use it.

By publishing content on Farewell Fund, you grant Farewell Fund a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, publish, translate, distribute and promote that content solely for the purpose of operating, improving and promoting the Farewell Fund platform and your fundraising campaign.

You confirm that:

  • You own the content you upload or have permission to use it.
  • Your content does not infringe the intellectual property rights of any third party.
  • You are responsible for obtaining any necessary permissions before publishing content on Farewell Fund.

All website content, software, logos, graphics, trademarks, text, branding and other intellectual property belonging to Farewell Fund remain our exclusive property unless otherwise stated. No person may reproduce, copy, modify, distribute or commercially exploit any part of the Farewell Fund website without our prior written permission.

20. Privacy and Protection of Personal Information

Farewell Fund is committed to protecting your personal information. We collect, store and process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and any other applicable South African legislation.

By using Farewell Fund you consent to the collection and processing of your personal information for purposes including:

  • Creating and managing user accounts.
  • Processing donations.
  • Verifying campaigns.
  • Preventing fraud.
  • Communicating with users.
  • Complying with legal and regulatory obligations.

21. Farewell Fund's Rights

Farewell Fund reserves the right, at its sole discretion, to:

  • Refuse or remove any campaign.
  • Suspend or terminate any user account.
  • Request additional verification at any stage.
  • Decline to process or release funds.
  • Correct errors appearing on the website.
  • Modify, suspend or discontinue any part of the Services.
  • Investigate complaints relating to campaigns.
  • Report suspected fraud or unlawful conduct to the relevant authorities.
  • Reverse or cancel donations where required by law or where fraud is suspected.
  • Retain interest earned on funds held pending verification or payout, where permitted by law.

Farewell Fund may also remove campaigns that:

  • Contain misleading information.
  • Breach these Terms and Conditions.
  • Damage the reputation of the platform.
  • Pose legal or regulatory risks.
  • Are no longer consistent with the purpose of Farewell Fund.

22. Suspension and Termination

Farewell Fund may suspend, restrict or permanently terminate access to the platform where a user:

  • Provides false or misleading information.
  • Commits or attempts to commit fraud.
  • Violates these Terms and Conditions.
  • Misuses donations.
  • Interferes with the operation or security of the platform.
  • Uses the platform for unlawful purposes.

Suspension or termination does not affect Farewell Fund's right to recover losses, withhold funds where legally justified or report unlawful conduct to the relevant authorities.

23. Disclaimer

Farewell Fund provides its Services on an "as available" and "as is" basis. Although we take reasonable steps to maintain a secure and reliable platform, we do not warrant that:

  • The website will always be available or uninterrupted.
  • Every campaign is accurate or complete.
  • Every fundraising campaign will receive donations.
  • Every fundraising goal will be achieved.
  • The website will be free from technical errors at all times.

Users access and use Farewell Fund entirely at their own risk.

24. Limitation of Liability

To the fullest extent permitted by South African law, Farewell Fund, its directors, shareholders, employees, contractors, service providers and representatives shall not be liable for any direct, indirect, incidental, consequential or special damages arising from:

  • Use of the platform.
  • Inability to use the platform.
  • Delays in campaign verification.
  • Payment processing delays.
  • Campaign failure.
  • Loss of donations.
  • Third-party payment provider failures.
  • Fraud committed by users.
  • Unauthorised access to user accounts beyond Farewell Fund's reasonable control.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

25. Indemnity

You agree to indemnify and hold harmless Farewell Fund, its directors, employees, shareholders, agents and service providers against any claim, loss, liability, damage, expense or legal costs arising from:

  • Your use of the platform.
  • Your breach of these Terms and Conditions.
  • Any false or misleading information you provide.
  • Any infringement of another person's rights.
  • Any misuse of donations received through Farewell Fund.

26. Dispute Resolution

If you have a complaint relating to Farewell Fund or another user of the platform, we encourage you to contact our support team first so that we may attempt to resolve the matter amicably.

If a dispute cannot be resolved through negotiation, either party may pursue any remedies available under South African law.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. The courts of South Africa shall have jurisdiction over any dispute arising from the use of Farewell Fund.

27. General Provisions

These Terms and Conditions constitute the entire agreement between Farewell Fund and its users regarding the use of the Services.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by Farewell Fund to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

Farewell Fund may assign or transfer its rights and obligations under these Terms where permitted by law. Users may not assign their rights or obligations without Farewell Fund's prior written consent.

These Terms and Conditions take effect immediately upon your use of Farewell Fund and remain binding for as long as you continue using the platform.
